Welcome to Nex Arc Learning. By accessing and using nex-arc-learning.com (the "Site"), you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using our Site.

1. Acceptance of Terms

By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these terms, please do not use our Site.

2. Description of Service

2A. Free Practice Exams

Nex Arc Learning provides free practice exam questions for AWS, Azure, Google Cloud Platform (GCP), and CISSP certification preparation. Our free service includes:

• Free practice exam questions (limited to 10 questions per exam)
• Explanations for correct and incorrect answers

2B. Paid Course Platform

In addition to free practice exams, we offer paid premium courses through our course platform:

What You Purchase:

• Lifetime access to premium course content
• Comprehensive practice exams with hundreds of questions
• Detailed explanations for all questions
• Access to course-specific resources and study materials
• Future updates to course content at no additional cost

Payment Processing:

• All payments are processed by Lemon Squeezy, LLC (our Merchant of Record)
• You contract directly with Lemon Squeezy for purchases
• Lemon Squeezy's Terms of Service apply to payment transactions: https://www.lemonsqueezy.com/terms
• We grant course access upon successful payment confirmation from Lemon Squeezy

Pricing:

• Prices displayed in USD ($) by default
• Lemon Squeezy automatically converts to your local currency
• Prices include all applicable taxes (Lemon Squeezy handles tax collection)
• Promotional discounts may be available via promo codes
• Current pricing: $19.99 for cloud certifications, $34.99 for CISSP

Payment Processing Fees: Our payment processor (Lemon Squeezy) may apply transaction fees. All prices displayed are final and inclusive of any applicable fees.

Currency Conversion: Prices are displayed in USD. All payments are processed through Lemon Squeezy, which handles currency conversion at checkout using real-time exchange rates if you pay in a different currency.

2C. Interview Preparation

Our Interview Prep feature lets you paste or upload a job title, job description, or your own CV to receive a relevant subset of our curated interview-practice questions, and optionally save those documents and your recent matches to your profile. By using this feature you agree that:

• You will paste only text you are entitled to use — your own CV, job titles, or publicly posted job descriptions. Do not paste confidential documents or another person’s personal data.
• You will not paste special-category data (e.g. health, religious, or trade-union information). The feature does not require it.
• If you choose to save a CV or job description to your profile, you remain responsible that it is your own data, you still must not include special-category data even when saving, and saved text is retained until you delete it (you can delete or export your saved documents and matches at any time in Settings).
• You will not use automated tools, bots, or bulk requests to scrape, harvest, or reconstruct the question bank, and you will not redistribute or resell its contents.
• The questions, intent notes, and example answers are for your personal interview preparation only.

2D. Nex Arc Pro Subscription

Nex Arc Pro is an optional recurring subscription that unlocks premium content for as long as the subscription stays active:

• Exams Pro — every premium practice-exam question bank and study guide.
• Interview Pro — the full interview-question bank and matcher answers.
• Complete — both of the above.

Billing & Renewal:

• Subscriptions are billed by Lemon Squeezy, LLC (our Merchant of Record) on a monthly or annual cycle, as selected at checkout. The price is shown before you subscribe; annual plans are offered at a discount to monthly.
• New subscriptions include a 7-day free trial. You are not charged during the trial. If you do not cancel before the trial ends, the subscription automatically converts to a paid plan and the first charge is taken.
• Paid subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. We will give advance notice of any price change, and you may cancel before it takes effect.
• If a renewal payment fails, Lemon Squeezy may retry it; access may be suspended until payment succeeds and the subscription may be cancelled if it remains unpaid.

Cancellation:

• You can cancel at any time — during or after the trial — from Dashboard → Manage Subscription or via the Lemon Squeezy customer portal.
• Cancelling during the trial stops the subscription before any charge.
• Cancelling a paid subscription stops future renewals; your access continues until the end of the period you have already paid for, after which it ends. If you are within 14 days of your first charge, our money-back guarantee applies (see Section 15).

Subscription access is a revocable licence tied to an active subscription. It is not “lifetime” access and ends when the subscription ends. One-time course purchases (Section 2B) are separate and unaffected by a subscription.

3. Use of Practice Exams

The practice exams provided on this Site are intended for:

• Educational purposes only: To help you prepare for certification exams
• Personal use: Not for commercial redistribution or resale
• Preview and evaluation: To assess whether our premium courses meet your needs

You agree not to:

• Copy, reproduce, or redistribute the practice questions without permission
• Use automated tools or bots to scrape content from the Site
• Reverse engineer or attempt to extract the question database
• Use the content for commercial purposes

4. No Guarantee of Certification Success

While our practice exams are designed to help you prepare, we make no guarantees or warranties regarding:

• Your ability to pass any certification exam
• The accuracy, completeness, or current relevance of questions
• The similarity of our questions to actual exam questions

Certification exams are administered by third parties, and passing is solely dependent on your preparation and performance.

Content Updates:

We update exam questions periodically to reflect changes in certification exam formats. However:

• Updates are made on a best-effort basis
• We cannot guarantee immediate inclusion of the latest exam changes
• Question formats may not exactly match current official exams
• Practice exams are for educational purposes only and do not guarantee exam success

5. Intellectual Property

All content on this Site, including but not limited to text, questions, answers, explanations, graphics, logos, and software, is the property of Nex Arc Learning or its content suppliers and is protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

6. Third-Party Links and Affiliates

6A. External Links

Our Site may contain links to third-party websites and services.

We are not responsible for:

• The content, accuracy, or practices of third-party websites
• Products or services purchased from third-party sites
• The privacy policies of external websites

Your interactions with third-party sites are governed by their terms and policies.

6B. Merchant of Record (Lemon Squeezy)

Important: For all paid course purchases, Lemon Squeezy, LLC acts as our Merchant of Record.

What this means:

• Lemon Squeezy is the seller (not Nex Arc Learning)
• Your contract for payment is with Lemon Squeezy
• We act as the content provider
• Lemon Squeezy handles all payment processing, tax collection, and payment-related support
• We handle content delivery and course access

7. Disclaimer of Warranties

This Site is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties regarding the accuracy or reliability of content

8. Limitation of Liability

To the fullest extent permitted by law, Nex Arc Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the Site
• Any errors or omissions in the content
• Any loss resulting from exam failure or certification denial
• Unauthorized access to your data

9. Indemnification

You agree to indemnify and hold harmless Nex Arc Learning, its affiliates, officers, and employees from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms of Service
• Your violation of any third-party rights
• Your misuse of the Site or its content

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page with an updated "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the revised terms.

11. Changes to the Site

We reserve the right to modify, suspend, or discontinue any aspect of the Site at any time without notice, including but not limited to:

• Adding or removing practice exams
• Changing question content or structure
• Updating promo codes or offers

12. User Conduct

When using our Site, you agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Transmit malicious code or viruses
• Interfere with other users' experience

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, specifically:

• Bürgerliches Gesetzbuch (BGB - German Civil Code)
• Digitale-Dienste-Gesetz (DDG - Digital Services Act)
• Datenschutz-Grundverordnung (DSGVO / GDPR - General Data Protection Regulation)

Excluding:

• United Nations Convention on Contracts for the International Sale of Goods (CISG)
• German conflict of law rules

Jurisdiction:

Disputes shall be resolved in the courts of Kaiserslautern, Germany.

Exception for Consumers:

If you are a consumer (as defined in BGB § 13):

• Mandatory consumer protection laws of your country may apply
• You may bring claims in your country of residence
• Our mandatory liability under consumer law cannot be excluded

15. Refund and Cancellation Policy

15.1 14-Day Money-Back Guarantee

We want you to buy with confidence. If you are not satisfied, you can request a full refund within 14 days — no questions asked. The guarantee applies to:

• One-time course purchases — within 14 days of purchase; and
• Nex Arc Pro subscriptions — within 14 days of your first charge (the charge taken when your 7-day free trial converts to a paid plan). See Section 15.7.

How to request a refund: email info@nex-arc-learning.com with the email address used for the purchase and your order ID (from your Lemon Squeezy receipt). We do not need a reason. Refunds are issued to your original payment method, normally within a few business days. When a refund is processed, access to the refunded course or subscription is revoked (see Section 15.5).

This voluntary guarantee is offered in addition to any statutory rights you may have, including your statutory right of withdrawal where it applies (see our Right of Withdrawal page) and the mandatory rights described in Section 15.8.

15.2 Try Before You Buy - Free Sample Exams

We offer FREE sample exams (10 questions) for every certification so you can experience our format, question quality, and detailed explanations before purchasing. We strongly encourage you to complete the free sample exam before making a purchase decision.

Free samples are available on each exam page. This allows you to make an informed decision and ensures you know exactly what you're purchasing.

15.3 Refunds After the 14-Day Window

Even after the 14-day money-back window has passed, we may still grant a refund in circumstances such as:

• Technical Issues: Persistent technical problems preventing course access that our support team cannot resolve
• Duplicate Purchases: Accidental duplicate purchases of the same course
• Content Discrepancy: Course content significantly different from the description at time of purchase

To request a review, contact us at info@nex-arc-learning.com with your order details and a description of the issue. These cases are in addition to your statutory rights (Section 15.8), which always apply.

15.4 Payment Processor Discretion

Lemon Squeezy, LLC ("Lemon Squeezy") acts as our Merchant of Record for all purchases. Lemon Squeezy retains discretion over refund decisions as per their buyer protection policies and may approve refunds in exceptional circumstances at their sole discretion.

This acknowledgment does not alter our policy above but recognizes that Lemon Squeezy, as the seller of record, may independently process refunds in accordance with their own policies and applicable consumer protection laws.

15.5 Course Access After Refund

If a refund is processed (whether through an exception or by Lemon Squeezy's discretion), your access to the purchased course will be immediately and automatically revoked. You will no longer be able to access the premium practice exam questions, explanations, or any associated course materials.

15.6 Questions About This Policy

If you have questions about this refund policy before purchasing, please contact us at info@nex-arc-learning.com. We recommend trying our free sample exams first to ensure our products meet your expectations.

15.7 Subscriptions and Free Trials

Nex Arc Pro subscriptions (Section 2D) are covered by the money-back guarantee, adapted for recurring billing:

• The 7-day free trial lets you evaluate Nex Arc Pro at no cost. You may cancel at any time during the trial and you will not be charged.
• Money-back guarantee: if you are not satisfied, request a full refund of your first charge within 14 days of it being taken — no questions asked (Section 15.1).
• Cancel any time: cancelling stops future renewals; you keep access until the end of the period you have already paid for (Section 2D).
• Renewals: after the first 14 days, charges for a renewal period that has already begun are not automatically refunded and we do not provide pro-rata refunds for the unused part of a period — but you can cancel before each renewal to avoid further charges, and we may still issue a goodwill refund on request.

15.8 Your Mandatory Statutory Rights

Nothing in this Section 15 limits or excludes any consumer rights that cannot be waived under the mandatory law of your country of residence. In particular, and without limitation:

• if digital content or a digital service we provide is faulty, not as described, or does not conform to the contract, you keep your statutory rights to a remedy (for EU/EEA and UK consumers, under the applicable consumer-conformity rules);
• Brazil: consumers retain the 7-day right of regret for distance purchases under Art. 49 of the Consumer Defence Code (CDC);
• Australia: our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law;
• where your local law grants a non-excludable right of withdrawal or refund that the policy above does not provide, that mandatory right prevails.

Because Lemon Squeezy is the Merchant of Record, Lemon Squeezy is the seller to you and may also grant refunds at its own discretion or to meet its own legal obligations, independently of the policy above.

16. User Accounts

16.1 Age Requirements

Minimum Age:

• Free Practice Exams: 13+ years (in compliance with COPPA and GDPR age of digital consent)
• Paid Courses: 18+ years, OR 13-17 years with verifiable parental consent

By registering for a paid account, you confirm that you meet these age requirements.

16.2 Account Registration

To access paid courses, you must create an account using one of the following methods:

Email/Password Registration:

• Provide a valid email address and choose a secure password
• Verify your email address via the confirmation code we send
• Provide accurate information
• Meet the age requirements stated above

Google Sign-In:

• Authenticate via your existing Google account — no separate password required
• Your email is verified by Google; your name and email are auto-populated from your Google profile
• If an account already exists with the same email address, it will be linked automatically
• Meet the age requirements stated above

Account Security:

• You are responsible for maintaining account confidentiality
• Do not share login credentials
• If you use Google Sign-In, the security of your Nex Arc account is also dependent on the security of your Google account — enable two-factor authentication on Google for best protection
• We are not liable for losses arising from unauthorized use of your account, including losses resulting from a compromised Google account
• Notify us immediately of unauthorized access: info@nex-arc-learning.com

Account Termination:

We may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent activity
• Sharing account credentials
• Chargebacks or payment disputes

You may delete your account at any time via the dashboard (Dashboard → Delete my account) or by emailing privacy@nex-arc-learning.com.

Account Deletion Process:

• Deletion runs on a 7-day grace window: your account is immediately disabled (you cannot sign in) and we email you a single-use cancel link valid for 7 days. Clicking the link before the deadline restores your account.
• After the 7-day grace expires without cancellation, deletion becomes permanent and irreversible.
• All access to purchased courses is revoked at the start of the grace window; if you cancel within 7 days, access is restored.
• Once permanent, you cannot recover your purchase history or course progress.
• Deleting your account does not affect your 14-day money-back guarantee or any other refund right under Section 15 — you can request an eligible refund before or after deletion.
• Transaction records are retained for 10 years per German tax law (§ 147 AO) in anonymized form (your name and email are removed and the user reference is replaced with a one-way hash; billing address and payment details are held only by Lemon Squeezy, our payment processor, never by us).
• Deleting your Nex Arc account does not delete or disconnect your Google account. To revoke Nex Arc Learning's access to your Google account, visit Google Account Permissions.

17. Course Access and License Terms

License Grant:

Upon purchase, we grant you a:

• Non-exclusive, non-transferable, revocable license
• For personal, non-commercial use only
• To access and view course content online
• Lifetime access (as long as platform operates)

Restrictions - You May NOT:

• Share your login credentials with others
• Download or redistribute course videos (unless explicitly allowed)
• Use content for commercial purposes
• Create derivative works
• Use automated tools to scrape or download content
• Resell or sublicense course access

Content Ownership:

• All course content remains our intellectual property
• You receive only a license to access, not ownership
• Trademarks, logos, and branding are protected
• Certification exam materials are based on publicly available specifications

Course Updates:

• We may update or modify course content at any time
• Updates provided at no additional cost
• We are not obligated to maintain specific content indefinitely
• Course structure and format may change

Platform Availability:

• We strive for 99% uptime but make no guarantees
• Scheduled maintenance may cause temporary unavailability
• We are not liable for interruptions outside our control
• No compensation for temporary service disruptions

Service Discontinuation:

In the unlikely event we discontinue our service:

• We will provide 90 days advance notice via email
• You will have the opportunity to download or archive your course materials during the notice period
• Purchases made within the previous 14 days remain covered by our money-back guarantee (Section 15); for older "lifetime access" purchases, "lifetime" means access for the operational life of the platform, which such a notice would bring to an end
• We will provide information about alternative exam preparation resources

• Lemon Squeezy determines and collects all applicable taxes (including VAT/GST) based on your location
• All prices shown are exclusive of taxes (taxes added at checkout based on your country)
• Tax invoices are issued by Lemon Squeezy

About Nex Arc Learning (Free Content Provider):

As a German Kleinunternehmer under § 19 UStG (German VAT Act), Nex Arc Learning does not charge VAT on free content and services.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
